This notice supplements our Privacy Policy. It explains how we process personal data in the relyd partner programme: data about partners who apply for or take part in the programme under the Partner Agreement, and data about customers whose workspace is attributed to a partner. For everything not covered here, the Privacy Policy applies.
1. Who is responsible
relyd's headquarters is at Breitfeldstrasse 8, 9015 St. Gallen, Switzerland.
The controller is the relyd company that is the contracting party: for partners under section 2 of the Partner Agreement, for customers under section 2 of the Master Subscription Agreement (MSA). This is relyd Limited, 3 Ballsbridge Park, Dublin, D04 C7H2, Ireland, for the European Union, the European Economic Area, the United Kingdom, Switzerland and Liechtenstein, and relyd Inc., 28-07 Jackson Ave, New York, NY 11101, USA, for all other countries. Contact for all data protection matters: privacy@relyd.co.
2. Data about partners
When a business applies and takes part, we process data about its contact persons:
- application: name, company, website, e-mail address, telephone number if given, approximate number of customers and the message in the application form;
- participation: partner code and partner link, partner level, country, date of admission, training and certification dates, status;
- settlement: VAT number or tax identification, bank details for the payout, tax forms where required (for example IRS Form W-9 or W-8BEN-E), statements, credit notes and the commissions per customer and period;
- communication: e-mails and notes about the cooperation.
3. Data about customers attributed to a partner
A customer is attributed to a partner when it registers through the partner link, enters the partner code during registration or when relyd assigns it after a deal registration (section 4 of the Partner Agreement). For this purpose we store with the customer's workspace:
- the partner code;
- the date and the source of the attribution (link, code or manual assignment).
For the commission and the monthly overview, relyd tells the partner, per attributed customer:
- the name of the company or workspace;
- the plan and whether the subscription is active or has ended;
- since when the customer is attributed;
- the commission earned per period.
relyd does not give the partner access to the workspace, to users or to Customer Data under the MSA. A partner only works in a workspace if the customer invites it as a user.
4. Requests forwarded to a partner
If a customer or prospect asks relyd for help with the set-up, relyd forwards the request to a certified partner only with the person's consent. We then pass on name, company, contact details, region, language and the content of the request.
5. Purposes and legal basis
- Reviewing applications and carrying out the Partner Agreement (admission, training, support, settlement and payout): performance of a contract and steps before entering into it (Art. 6(1)(b) GDPR).
- Keeping accounting records and complying with tax law (credit notes, statements, tax forms): our legal obligation (Art. 6(1)(c) GDPR).
- Attributing customers to a partner and informing the partner as described in section 3: our legitimate interest in running the partner programme and paying the commissions agreed with the partner (Art. 6(1)(f) GDPR). We limit the information to what the partner needs to check its commission.
- Forwarding requests to a partner (section 4): your consent (Art. 6(1)(a) GDPR).
6. No tracking
The partner link only fills in the partner code for the registration that follows. We do not set a cookie for it and do not use tracking pixels or third-party tracking for the partner programme. The technical data of every website visit is processed as described in section 2.1 of our Privacy Policy.
7. Recipients
- The partner: only the data listed in sections 3 and 4.
- Hosting and e-mail: our hosting provider in the EU and our e-mail service provider (see our list of subprocessors).
- Banks, tax advisers and authorities, where needed for the payout or required by law.
We do not sell personal data and do not pass it on for other companies' advertising.
8. How long we keep data
| Data | Retention |
|---|---|
| Application that is not accepted | deleted 6 months after the decision |
| Partner data | for the term of the Partner Agreement, then deleted, except for the records below |
| Statements, credit notes, tax forms | for the statutory retention period for accounting records (generally up to 10 years) |
| Attribution with the customer's workspace | as long as the workspace exists; afterwards deleted with it, except where it is part of a statement |
| Forwarded request | with the partner under its own responsibility; at relyd 24 months after the last contact |
9. Objection
Customers may object at any time to the attribution or to relyd informing the partner (section 3), and withdraw consent to forwarding (section 4), by writing to privacy@relyd.co. relyd then stops informing the partner about that customer. Withdrawal does not affect processing before it.
10. Your rights
You have the rights described in section 8 of our Privacy Policy: access, rectification, erasure, restriction, data portability, objection and complaint to a supervisory authority.
11. Changes
We may update this notice. The current version is always available on legal.relyd.co.
